Agreement and eligibility
These terms apply to the SayPop website, store, products, and connected services that link to them. By using them, you agree to these terms. If you do not agree, do not use them.
Purchases and account setup must be completed by an adult who can enter a binding contract. A parent or legal guardian is responsible for a child's use of SayPop and for deciding whether generated content is appropriate.
Orders, prices, and payment
Your order is an offer to buy. We accept it when we confirm acceptance or ship the order, depending on the law that applies. We may decline or cancel an order for fraud concerns, stock errors, pricing mistakes, delivery restrictions, or legal reasons. If we cancel after payment, we will refund the amount charged.
Prices, discounts, taxes, delivery charges, and currency are shown at checkout. We may change future prices or correct obvious errors. We will not change the agreed price of an accepted order except with your consent or where the law allows.
Product information and availability
We try to keep descriptions, images, specifications, and availability accurate. Screen colors, generated images, and packaging may vary. Included items are the items listed in the offer you select at checkout. Features that depend on internet access or third-party services may be changed, interrupted, or unavailable from time to time.
Safe and proper use
Use SayPop only for its intended purpose and follow the product guide, age guidance, warnings, and charging instructions. An adult should supervise children, initial setup, charging, paper changes, and use of small accessories or cutting tools.
- Do not stand, sit, climb, or step on the product or leave it where someone may trip or fall on it.
- Keep it away from water, excessive heat, fire, and damaged cables or batteries.
- Do not open, modify, puncture, crush, or attempt unauthorized repairs.
- Use compatible paper, accessories, power sources, and cables.
- Stop using the product if it is damaged, unusually hot, swollen, leaking, or behaving unexpectedly.
To the fullest extent permitted by law, SayPop is not responsible for harm caused by misuse, unsafe placement, ignored warnings, unauthorized modification or repair, incompatible accessories, or use outside the product's intended purpose. This does not exclude liability that the law does not allow us to exclude, including liability arising from a defective product or our negligence where applicable.
Voice and generated content
Connected features may turn spoken prompts into generated text or images. Generated content can be unexpected, inaccurate, incomplete, or unsuitable. It is for creative play, not professional, medical, legal, safety, or factual advice. An adult should review content before a child uses, prints, or shares it.
Do not submit content that is unlawful, threatening, exploitative, sexually explicit, hateful, infringing, invasive of privacy, or harmful to children. Do not include confidential information or personal information you do not have permission to use. We may block prompts or suspend connected features to protect users, comply with law, or prevent abuse.
Your content and our materials
You keep any rights you have in prompts or other material you submit. You give us and our service providers a limited, worldwide license to host, process, transmit, and reproduce that material only as needed to provide, secure, support, and legally operate the requested service.
The SayPop name, site design, text, graphics, software, and other materials are owned by SayPop or its licensors. You may use them only for personal, non-commercial use unless we give written permission.
Returns, shipping, and privacy
Our Return & refund policy, Shipping policy, and Privacy policy form part of these terms.
Mandatory warranties and consumer rights
Nothing in these terms limits a warranty, guarantee, remedy, or other right that cannot legally be limited. This includes qualifying rights under US state law, EU and UK consumer law, the Australian Consumer Law, and New Zealand's Consumer Guarantees Act and Fair Trading Act.
Except for those mandatory rights and any express written warranty we provide, the site and connected services are provided “as available” and we disclaim implied warranties only to the extent the law permits.
Limitation of liability
To the fullest extent permitted by law, SayPop and its service providers will not be liable for indirect, incidental, special, exemplary, or consequential loss, or loss of profits, data, goodwill, or business opportunity arising from use of the site, product, or connected service. Where liability may lawfully be limited, our total liability will not exceed the amount you paid for the product or service giving rise to the claim during the 12 months before the event.
These limits do not apply to fraud, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where it cannot be limited, defective-product liability that cannot be excluded, or any mandatory consumer remedy.
Availability and third-party services
We do not promise uninterrupted or error-free connected features. We may maintain, update, restrict, or discontinue a feature where reasonably necessary. Shopify, payment processors, carriers, hosting providers, voice processors, and image-generation services may have separate terms. We are responsible for our own legal obligations and do not use these terms to avoid responsibility that the law places on us.
Governing law and disputes
Before filing a claim, please email us so we can try to resolve it. The laws and courts that apply will be determined under applicable conflict rules and the location of the SayPop business. If you are a consumer, these terms do not deprive you of mandatory protections or the right to use courts or dispute procedures available in your home jurisdiction.
Changes and general terms
We may update these terms for future use when products, services, or laws change. The date above shows the latest version. If one part is unenforceable, the rest remains effective. Our failure to enforce a term is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a business reorganization or sale, subject to applicable law.
